AvachaTech, LLC (“AvachaTech,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how information is handled when you use the Hemispheres mobile application, visit the Hemispheres website, or communicate with us about Hemispheres.

This Privacy Policy applies to:

• the Hemispheres mobile application;
• the Hemispheres website;
• customer-support and feedback communications relating to Hemispheres; and
• other Hemispheres services that link to this Privacy Policy.

1. Privacy Summary

Hemispheres is designed to collect as little personal information as reasonably possible.

The current version of the Hemispheres application:

• does not require an account;
• does not require you to provide your name or email address;
• does not collect precise location;
• does not access your contacts, photographs, microphone, camera, health information, or other sensitive device resources;
• does not use advertising identifiers;
• does not contain third-party advertising;
• does not track you across applications or websites;
• does not sell or share personal information for targeted advertising;
• does not use third-party analytics or behavioral-profiling tools;
• does not transmit gameplay progress to AvachaTech; and
• stores gameplay progress and settings locally on your device.

We may receive limited information when you voluntarily contact us, visit our website, or purchase or download Hemispheres through an app marketplace. Those circumstances are described below.

2. Information Stored Locally on Your Device

Hemispheres may store the following information locally on your device:

• application settings;
• sound and haptic preferences;
• interface and accessibility preferences;
• preferred session length;
• gameplay progress;
• problems attempted;
• scores and answer classifications;
• hint usage;
• streaks and performance summaries; and
• unfinished game sessions.

This information supports application functionality and allows you to continue your progress.

Local application data is not transmitted to AvachaTech under the current design. It remains under the control of your device and operating system.

You can ordinarily delete this locally stored information by deleting the Hemispheres application from your device. Reinstalling the application may not restore prior progress unless the device or operating system independently restores application data from a backup.

AvachaTech cannot access, retrieve, correct, or delete information that exists only on your device.

3. Information You Provide to Us

You may voluntarily provide information when you:

• send us an email;
• request customer support;
• report an error;
• submit feedback or a suggestion;
• respond to a survey that we choose to offer;
• contact us through a website form; or
• communicate with us in another way.

Depending on what you choose to provide, this information may include:

• your name;
• your email address;
• the contents of your message;
• screenshots or attachments;
• information about your device or operating system;
• details about an application error; and
• other information you voluntarily include.

Please do not send sensitive personal information that is not necessary for us to address your question or support request.

We use voluntarily provided information to:

• respond to you;
• provide customer support;
• investigate technical problems;
• correct application or content errors;
• improve Hemispheres;
• maintain records of support matters;
• protect the security and integrity of our Services; and
• comply with legal obligations.

4. Website Information

When you visit the Hemispheres website, our website host or technical service providers may automatically process limited information needed to deliver and secure the website.

This information may include:

• Internet Protocol address;
• browser type;
• device type;
• operating-system information;
• requested pages;
• referring page;
• date and time of access;
• approximate geographic region derived from an Internet Protocol address;
• server logs; and
• security or error information.

We use this information only as reasonably necessary to:

• operate and display the website;
• maintain website security;
• identify technical problems;
• prevent fraud, abuse, or attacks;
• understand basic website performance; and
• comply with legal obligations.

Unless this policy is updated to state otherwise, we do not use website information for behavioral advertising, cross-site tracking, or the creation of advertising profiles.

Cookies and Similar Technologies

The website may use cookies or similar technologies that are strictly necessary for website operation, security, accessibility, load balancing, or user-requested functionality.

We do not use advertising cookies or tracking technologies to follow visitors across unrelated websites.

If we later introduce optional analytics, marketing cookies, or other nonessential tracking technologies, we will update this Privacy Policy and provide any notice or consent mechanism required by applicable law before using them.

5. App Marketplace Information

If you download or purchase Hemispheres through Apple’s App Store or another app marketplace, the marketplace may process information related to:

• your marketplace account;
• your device;
• your download or purchase;
• payment processing;
• refunds;
• subscriptions, if any are later offered;
• family sharing;
• marketplace analytics; and
• fraud prevention.

The marketplace processes that information under its own privacy policy and terms.

AvachaTech does not receive your complete payment-card or bank-account information from Apple. We may receive aggregated sales information, transaction records, proceeds information, or other marketplace reports made available to application developers.

Information collected independently by Apple or another marketplace is not controlled by this Privacy Policy.

6. Information We Do Not Collect Through the Application

Under the current design, AvachaTech does not collect through the Hemispheres application:

• names or usernames;
• email addresses;
• telephone numbers;
• postal addresses;
• account credentials;
• precise or approximate device location;
• contacts;
• photographs or videos;
• camera or microphone recordings;
• health or fitness information;
• financial-account or payment-card information;
• government identification numbers;
• biometric information;
• advertising identifiers;
• browsing history;
• search history;
• data from other applications;
• user-generated social content;
• private messages between users; or
• gameplay information transmitted from the device.

Hemispheres does not currently include accounts, multiplayer functions, social sharing, cloud synchronization, personalized advertising, or third-party analytics.

If the application’s data practices materially change, we will update this Privacy Policy and any applicable App Store privacy disclosures before or when the new practices are introduced.

7. How We Use Information

When AvachaTech receives information under this Privacy Policy, we may use it to:

• provide, maintain, and improve Hemispheres;
• operate and secure our website;
• answer support requests and other communications;
• diagnose and correct software, content, or mathematical errors;
• evaluate voluntary feedback;
• manage purchases, refunds, or marketplace-related inquiries;
• detect and prevent fraud, misuse, security incidents, or unlawful activity;
• establish, exercise, or defend legal claims;
• comply with applicable laws, regulations, court orders, or lawful governmental requests; and
• complete a corporate transaction involving AvachaTech or Hemispheres.

We do not use personal information for targeted advertising or cross-context behavioral advertising.

8. How We Disclose Information

We do not sell personal information.

We may disclose limited information in the following circumstances:

Service Providers

We may use service providers to support functions such as:

• website hosting;
• domain-name services;
• business email;
• customer support;
• data storage;
• security;
• legal services;
• accounting; and
• application distribution.

Service providers may process information only as reasonably necessary to perform services for us and are expected to protect it appropriately.

Legal and Safety Reasons

We may disclose information when we reasonably believe disclosure is necessary to:

• comply with applicable law or legal process;
• respond to a valid governmental request;
• protect the rights, property, or safety of AvachaTech, our users, or others;
• investigate fraud, abuse, or security threats; or
• establish, exercise, or defend legal claims.

Business Transactions

If AvachaTech is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction, information held by AvachaTech may be disclosed or transferred as part of that transaction.

Any successor’s use of personal information will remain subject to this Privacy Policy unless you are notified of a change as required by law.

With Your Direction or Consent

We may disclose information when you direct us to do so or provide consent.

9. Data Retention

Information stored only within the Hemispheres application remains on your device until:

• you delete it through functionality made available by the application;
• you delete the application;
• your device or operating system removes it; or
• it is otherwise erased through device-management or backup settings.

AvachaTech does not control retention of information stored only on your device.

Information that you voluntarily send to us may be retained for as long as reasonably necessary to:

• respond to your request;
• provide support;
• investigate or document a reported issue;
• improve Hemispheres;
• maintain appropriate business records;
• resolve disputes;
• enforce our agreements; or
• comply with legal obligations.

Routine website server and security logs may be retained for a limited period appropriate to operational, diagnostic, and security needs.

We may retain information longer when required by law, necessary for security or fraud prevention, or relevant to an actual or anticipated legal claim.

When information is no longer reasonably required, we will delete it or de-identify it, subject to backup, archival, and legal-retention requirements.

10. Your Choices and Privacy Rights

Depending on where you live and the laws that apply, you may have rights concerning personal information held by AvachaTech, including the right to:

• request access to personal information;
• request correction of inaccurate personal information;
• request deletion of personal information;
• obtain information about how personal information is used or disclosed;
• object to or restrict certain processing;
• withdraw consent when processing is based on consent;
• receive a portable copy of certain information; and
• appeal a decision concerning a privacy request.

Because Hemispheres does not require an account and gameplay information remains on the device, AvachaTech may have little or no information that can be associated with you.

To submit a privacy request, contact us using the information in Section 18. Please include enough information for us to understand and respond to your request. We may need to verify your identity before fulfilling certain requests.

We will not discriminate against you for exercising an applicable privacy right.

Local Application Data

For information stored only on your device, you must use the application or device controls available to you. Deleting the application will generally delete its locally stored data, subject to operating-system backups or restoration features.

Marketing Communications

We do not currently send Hemispheres marketing emails. If we introduce them, they will include a method to unsubscribe. You may still receive nonmarketing communications relating to a transaction, support request, security matter, or legal notice.

Tracking Choices

Hemispheres does not currently track users across applications or websites and does not request permission under Apple’s App Tracking Transparency framework.

11. California Privacy Notice

This section applies only to the extent the California Consumer Privacy Act, as amended, applies to AvachaTech’s processing of personal information.

During the preceding 12 months, AvachaTech may have collected the following categories of personal information through the Hemispheres website or voluntary communications:

• identifiers, such as a name, email address, Internet Protocol address, or device-related information;
• Internet or electronic-network activity, such as server logs and website interactions;
• approximate location inferred from an Internet Protocol address;
• commercial information supplied by an app marketplace, such as transaction or purchase records; and
• communications and other information that a person voluntarily provides.

We use these categories for the purposes described in this Privacy Policy, including support, application and website operation, security, troubleshooting, business administration, and legal compliance.

We may disclose these categories to service providers, professional advisers, governmental authorities when legally required, and parties to a business transaction.

AvachaTech does not sell personal information and does not share personal information for cross-context behavioral advertising. We do not knowingly sell or share the personal information of consumers under 16.

If applicable, California residents may request access, correction, or deletion and may obtain information concerning our collection, use, and disclosure of personal information. Requests may be submitted using the contact information in Section 18.

12. Children’s Privacy

Hemispheres is designed for a broad audience, including teenagers and adults, and is not directed specifically to children under 13.

The application does not require an account and does not knowingly collect personal information from children through its gameplay functions.

A child should not send personal information to AvachaTech through email, a website form, or another support channel without the involvement and consent of a parent or legal guardian.

If you are a parent or legal guardian and believe that a child has provided personal information to us, contact us. We will investigate and delete the information when required by applicable law.

We may take reasonable steps to verify the identity and authority of a person making a request on behalf of a child.

13. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information within our control.

No method of electronic transmission or storage is completely secure. We therefore cannot guarantee that information will never be accessed, disclosed, altered, lost, or destroyed without authorization.

You are responsible for maintaining the security of your device, operating-system account, backups, app-marketplace account, and email account.

14. International Users

AvachaTech is based in the United States.

If you provide information to AvachaTech from another country, that information may be transferred to and processed in the United States or another country where our service providers operate. Privacy laws in those locations may differ from the laws where you live.

Where required, we will use an appropriate legal basis and safeguards for international transfers of personal information.

15. Automated Decision-Making

Hemispheres automatically evaluates mathematical expressions and assigns game feedback, classifications, and scores.

These automated evaluations are gameplay functions. They are not used to make decisions concerning employment, credit, housing, insurance, education admission, legal rights, or access to essential services.

Hemispheres does not use personal information for automated profiling that produces legal or similarly significant effects.

16. Third-Party Links and Services

Our website or application may link to third-party websites or services.

We do not control the privacy or security practices of third parties. Their collection and use of information are governed by their own privacy policies and terms. You should review those policies before providing information.

17. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in:

• Hemispheres features;
• our information practices;
• applicable law;
• app-marketplace requirements; or
• our service providers.

When we update the policy, we will revise the “Last Updated” date. If a change materially affects how we collect, use, or disclose personal information, we will provide additional notice or obtain consent when required by law.

We encourage you to review this Privacy Policy periodically.
