Oddball Terms

Effective Date: July 1, 2026

These Terms of Use (“Terms”) apply to your use of Oddball, a local party game for social deduction and hidden-information gameplay, played in person on a shared device. Oddball is provided by AvachaTech, LLC (“AvachaTech,” “we,” “us,” or “our”).

By downloading, accessing, or using Oddball, you agree to these Terms. If you do not agree to these Terms, do not use Oddball.

1. About Oddball

Oddball is a family-friendly party game intended for local, in-person play. The app allows players to participate in gameplay using player names and avatars chosen on the device.

Oddball does not require an account, login, internet connection, online multiplayer service, cloud sync, or server-based gameplay.

2. App Store Terms

Oddball is distributed through the Apple App Store. Your use of Oddball is also subject to applicable Apple terms, including Apple’s standard end-user license terms for apps distributed through the App Store, unless Apple or AvachaTech provides different applicable terms.

These Terms are intended to supplement, not replace, any applicable Apple App Store terms.

3. Eligibility and Family Use

Oddball is intended for a general audience and is not specifically directed to children under 13.

Children may use Oddball only with the permission and supervision of a parent or legal guardian. Parents and guardians are responsible for determining whether Oddball is appropriate for their household, group, or setting.

4. Local Player Names and Avatars

Oddball may allow players to enter names or nicknames and choose avatars on the device. You should avoid entering sensitive personal information as a player name.

Player names and avatar selections are intended for local gameplay on the device. Oddball does not transmit player names or avatar selections to AvachaTech.

5. User Conduct and Game Responsibility

Oddball is designed to be fun, social, and family-friendly. You are responsible for how you use the app and for the environment in which the game is played.

You agree not to use Oddball to harass, bully, shame, threaten, discriminate against, or intentionally embarrass another person. You are responsible for choosing appropriate players, settings, categories, and boundaries for your group.

If a player is uncomfortable, you should stop, pause, change categories, or end the game as appropriate.

6. Game Content

Oddball includes prompts, categories, game text, graphics, sounds, icons, avatars, and other content. Some prompts and app assets may have been generated or assisted by artificial intelligence tools and then selected, edited, or incorporated by AvachaTech.

We may update, revise, add, remove, or replace prompts, categories, rules, game mechanics, features, and other content at any time.

7. No User-Generated Content Submission

Oddball does not currently allow users to submit, upload, publish, or share custom prompts, categories, or other user-generated content with AvachaTech or with other users.

If we add user-generated content features in the future, we may update these Terms before or when those features become available.

8. Purchases and Fees

Oddball may be offered as a paid app for a one-time purchase price through the Apple App Store. Any purchase is handled by Apple and is subject to Apple’s payment, refund, and App Store policies.

Oddball does not currently include advertisements, subscriptions, or in-app purchases.

9. Privacy

Your use of Oddball is also governed by our Privacy Policy, which explains what information the app does and does not collect.

As currently designed, Oddball does not require accounts, does not use AvachaTech servers, does not include third-party advertising, does not include third-party tracking, and does not transmit player names or gameplay data to AvachaTech.

10. Intellectual Property

Oddball, including its design, software, game mechanics, text, prompts, categories, graphics, icons, sounds, branding, and other content, is owned by AvachaTech or licensed to AvachaTech and is protected by applicable intellectual property laws.

You may use Oddball for personal, non-commercial gameplay. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from Oddball except as allowed by applicable law or Apple’s applicable app terms.

11. Third-Party Materials

Oddball may include third-party or platform-provided materials, such as sound library elements or standard Apple emoji characters used as avatars. Such materials remain subject to the rights and terms of their respective owners.

12. Updates and Availability

We may update, modify, suspend, or discontinue Oddball or any part of the app at any time. We do not guarantee that Oddball will always be available, compatible with every device, or free from errors.

Some features may change over time, including prompts, categories, gameplay rules, visual design, sounds, and settings.

13. Disclaimer of Warranties

Oddball is provided “as is” and “as available.” To the fullest extent permitted by law, AvachaTech disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that Oddball will be uninterrupted, error-free, secure, or suitable for every group, setting, player, or purpose.

14. Limitation of Liability

To the fullest extent permitted by law, AvachaTech will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of data, loss of use, loss of goodwill, or other intangible losses arising from or related to your use of Oddball.

To the fullest extent permitted by law, AvachaTech’s total liability for any claim arising from or related to Oddball or these Terms will not exceed the amount you paid to purchase Oddball.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

15. Indemnity

You agree to defend, indemnify, and hold harmless AvachaTech, LLC and its owners, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from or related to your misuse of Oddball, your violation of these Terms, or your violation of another person’s rights.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we may provide notice in the app, on our website, or through another reasonable method.

Your continued use of Oddball after updated Terms become effective means you accept the updated Terms.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules.

To the extent any dispute is not subject to Apple’s applicable terms or another required process, the state and federal courts located in King County, Washington will have exclusive jurisdiction and venue over disputes arising from or related to these Terms or Oddball.
